Terms of Service

These Terms of Service ("Terms") govern your use of the Sentire Kenya Limited website at sentire.co.ke ("Site") and any managed ICT services ("Services") provided by Sentire Kenya Limited ("Sentire Kenya", "we", "us", or "our"). By accessing our Site or engaging our Services, you agree to be bound by these Terms.

1. Use of the Website

You may use this Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable Kenyan or international law or regulation.
  • Transmit unsolicited commercial communications or spam.
  • Attempt to gain unauthorised access to any part of the Site or our systems.
  • Introduce malware, viruses, or other malicious code into the Site.
  • Scrape, harvest, or collect data from the Site without our express written permission.

We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.

2. Managed ICT Services

The provision of managed ICT services, including but not limited to IT support, cybersecurity, cloud services, networking, and infrastructure, is governed by a separate Master Services Agreement ("MSA") or Service Level Agreement ("SLA") entered into between Sentire Kenya and the client. In the event of any conflict between these Terms and a signed MSA or SLA, the MSA or SLA prevails.

Any service descriptions, pricing, or specifications on this Site are for general information only and do not constitute a binding offer. All engagements are formalised through a written agreement.

3. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Sentire Kenya Limited or its content suppliers and is protected by Kenyan and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

Third-party trademarks (such as Microsoft, Sophos, Acronis, 3CX, ZKTeco, and Veeam) are the property of their respective owners. Their appearance on this Site indicates an authorised reseller relationship and does not imply ownership by Sentire Kenya.

4. Disclaimers and Limitation of Liability

This Site and its contents are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by Kenyan law, Sentire Kenya shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this Site or the information contained on it. Our total liability for any claim arising from your use of this Site shall not exceed KES 10,000.

Liability limits for managed ICT services delivered under contract are governed by the applicable MSA or SLA, not these Terms.

5. Third-Party Links

This Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of linked sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Linking to a third-party site does not imply endorsement by Sentire Kenya.

6. Privacy

Your use of this Site is also governed by our Privacy Policy , which is incorporated into these Terms by reference. By using this Site, you consent to the data practices described in the Privacy Policy.

7. Acceptable Use of Services

Clients using Sentire Kenya managed services agree not to use those services to:

  • Engage in any activity that is unlawful under Kenyan or international law.
  • Infringe the intellectual property rights of any third party.
  • Distribute malware, ransomware, or other harmful software.
  • Conduct unauthorised penetration testing or network scanning against systems not owned by the client.
  • Store or transmit content that is defamatory, obscene, or that violates any person's rights.

Violation of this acceptable use policy may result in immediate suspension of services without liability to Sentire Kenya.

8. Confidentiality

In the course of delivering managed ICT services, Sentire Kenya may have access to confidential business information and systems. We treat all client information as strictly confidential and will not disclose it to third parties except as required by law or with your written consent. Detailed confidentiality obligations are set out in the applicable MSA or SLA.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to this page. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. Changes to terms governing contracted services require written agreement between both parties.

10. Governing Law and Disputes

These Terms are governed by the laws of Kenya. Any disputes arising from or in connection with these Terms or your use of the Site shall first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, disputes shall be referred to the courts of Kenya, whose jurisdiction you irrevocably submit to.
